Welcome to Prompt Generator (operated by PG Team, hereinafter referred to as "we," "our," or "Prompt Generator"). The following Terms of Service ("Terms") set forth the conditions for your access to and use of the Prompt Generator website, AI prompt generation services, and related products. Account Registration

1. Account Creation

To use certain features of our services, you must create an account. You commit to providing accurate, complete, and up-to-date information during registration. You are responsible for maintaining the security of your account, including protecting your password and limiting access to your account.

Acceptable Use Policy

1. Prohibited Uses

You agree not to use our AI prompt generation services to create, generate, or facilitate:

• Illegal or Criminal Content: Any content that violates applicable laws, regulations, or promotes illegal activities
• Harassment or Hate Speech: Content that harasses, intimidates, threatens, or promotes hatred against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Copyright Infringement: Content that infringes on the intellectual property rights, privacy rights, or other rights of third parties
• Misleading or Deceptive Information: False, misleading, or fraudulent content intended to deceive others
• Pornographic or Violent Content: Excessively violent, pornographic, or sexually explicit content
• Fraudulent or Incendiary Content: Content designed to defraud others or incite violence, panic, or harm

2. Legal Reporting

If we become aware of any illegal, criminal, or harmful activity through our service, we reserve the right to report such activity to the appropriate law enforcement authorities in the relevant jurisdiction (Canada, United States, or other applicable jurisdictions).

3. Service Integrity

You agree not to:

• Distribute malware, viruses, or other harmful code
• Attempt unauthorized access to our systems, servers, or other users' accounts
• Interfere with or disrupt the operation of our services
• Use automated systems (bots, scripts) to access our services in ways that exceed normal usage patterns without authorization
• Reverse engineer, decompile, or attempt to extract source code from our services

4. Consequences of Violation

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account, without refund, and may be reported to law enforcement authorities.

Service Plans and Usage

1. Service Options

We offer two primary ways to use our services:

• Subscription Plans: Various subscription tiers with different usage quotas. All subscription plans have the same access rights and features; only the number of available prompts differs. Details are available on our Pricing page
• Pay As You Go: Purchase credits as needed without a recurring subscription. Credits can be used to generate prompts on demand

2. Usage Limitations

Service usage is limited based on your selected plan or available credits. Free trial offerings (if available) may have additional limitations. Exceeding your plan's limitations will require purchasing additional credits or upgrading your subscription.

Payment Terms

1. Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. You agree to provide accurate payment information and authorize us to charge your payment method for the services you select.

2. Subscription Billing

• Subscriptions are billed on a recurring basis (monthly, annually, or as specified at purchase)
• We reserve the right to change subscription prices at any time, but will provide advance notice to existing subscribers
• Price changes will not affect your current billing cycle; they will apply to subsequent renewals

3. Cancellations and Refunds

Subscription Plans:

• You may cancel your subscription at any time
• Cancellation will take effect at the end of your current billing cycle
• You will retain access to subscription features until the end of the paid period
• No refunds will be provided for the current billing period or any unused portion of a subscription

Pay As You Go Credits:

• Purchased credits that have not been used may be eligible for refund at our discretion
• No refunds will be provided for credits that have been used, regardless of the amount used or the number of prompts generated
• Refund requests must be submitted to [email protected] with a valid reason

Intellectual Property

1. Our Service and Content

All content on Prompt Generator, including but not limited to software, code, designs, text, graphics, interfaces, logos, images, and the underlying technology, is owned by PG Team or our licensors and is protected by copyright, trademark, and other intellectual property laws.

2. Generated Prompts

Ownership: All prompts generated through our service belong to you, the user. You retain full ownership and intellectual property rights to any prompts created using our service.

Freedom to Use: You are free to:

• Use generated prompts for any lawful purpose
• Modify, adapt, or build upon generated prompts
• Share generated prompts with others
• Use generated prompts commercially

No Restrictions: We do not claim any ownership rights to your generated prompts. You do not need to credit Prompt Generator when using generated prompts, though we appreciate attribution.

3. Your Account Information

You retain ownership of any information you provide to us (account details, input descriptions, etc.). You grant us a limited, non-exclusive license to use this information solely for the purpose of providing our services to you.

4. Feedback

If you provide feedback, suggestions, or ideas about our services, you grant us the right to use such feedback without restriction and without compensation to you.

Third-Party AI Services

Our service transmits your prompt generation requests to third-party AI service providers, including but not limited to:

• OpenAI (GPT models)
• Google (Gemini models)
• Anthropic (Claude models)
• Other AI service providers

These third-party services are governed by their own terms of service and privacy policies. We do not control how these providers process your requests, and we are not responsible for their actions, policies, or service quality.

Disclaimers

1. Services Provided "As Is"

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• Our services will be error-free, secure, or uninterrupted
• Generated prompts will meet your specific needs or expectations
• Generated prompts will be free of errors or inaccuracies
• Third-party AI services will be available or function correctly at all times

2. No Guarantee of Results

We do not guarantee any specific results from using generated prompts with AI systems. The quality and effectiveness of generated prompts may vary depending on numerous factors outside our control, including the AI system used, your input, and your specific use case.

3. Third-Party Links and Services

Our services may contain links to third-party websites or services, or integrate third-party functionality. We are not responsible for any third-party content, websites, products, or services.

Limitation of Liability

To the maximum extent permitted by Canadian law and California law, Prompt Generator, PG Team, and our service providers, partners, and licensors will not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or unavailability
• Errors or inaccuracies in generated prompts
• Actions or omissions of third-party AI service providers
• Any damages resulting from your use of generated prompts

Our total liability to you for all claims related to our services shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 CAD, whichever is greater.

Governing Law and Jurisdiction

These Terms are governed by the laws of Canada and, where applicable, the State of California (United States), without regard to conflict of law principles. This dual jurisdiction reflects:

• Our operational presence in Canada
• The location of upstream AI service providers in California

Any disputes arising from these Terms or our services shall be subject to the jurisdiction of the courts of Canada or California, as appropriate.

General Provisions

1. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Prompt Generator regarding the use of our services and supersede all prior or contemporaneous communications, proposals, and understandings, whether oral or written.

2. Modification of Terms

We may modify these Terms from time to time. When we make significant changes:

• We will post the revised Terms on our website
• We will update the "Last Updated" date at the top of this document
• We may notify you via email or through our service

Your continued use of our services after changes become effective indicates your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using our services.

3. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

4. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

5. Account Deletion

If you wish to delete your account and personal information, you must contact us at [email protected]. We do not provide self-service account deletion. Upon verification of your identity, we will process your deletion request promptly and delete your data immediately.
